Virginia has recently passed a law that will enable non-US citizens to legally get about using the roadways without needing a foreign driver’s license.
With passage of SB34, Virginia joins states like California, New York, Vermont, and Delaware in offering driving privileges to residents without citizenship, so long as they present the required documentation. According to the National Conference of State Legislatures, this makes Virginia the 16th state (plus D.C.) to allow undocumented immigrants to drive.
The DMV will issue driver privilege cards so long as the applicant is able to produce the following:
- Two proofs of identity (e.g., foreign passport and Consular identification document issued by country of citizenship)
- Two proofs of Virginia residency (e.g., monthly mortgage statement and utility bill)
- Proof of Social Security number (if one has been issued) or the individual’s taxpayer identification number (e.g., W-2 form or ITIN letter)
- Tax return documentation (e.g. Virginia Resident Form, Virginia Part-Year Resident Income Tax Return Form or Virginia Nonresident Income Tax Return Form, filed in the past 12 months)
The new law goes into effect January 1, 2021.
